US property law protects cultural relics of some groups but not slavery’s descendants

Evidence

Reading this made me lament that there are two systems of justice. There are laws that protect the cultural relics and property of Holocaust survivors and their descendants, and other laws that protect the same for Native Americans and their descendants. But they don’t exist for the descendants of chattel slavery—nor is there even a willingness to entertain that they should. That’s what I wanted to change with my case. — Tamara Lanier, From These Roots, 1216

  • XREF: Connects to the reader’s theme of property law as the afterlife of slavery and repatriation regimes (NAGPRA, Holocaust restitution) as the template Lanier invokes.
  • SEED: An essay comparing the three repatriation regimes — Holocaust, Native American, and absent African-American — as three tiers of who the law considers worth returning things to.
