The view from nowhere that guards against tyranny erases the community doing the judging
Evidence
Perhaps sharing some of Klausâs views, promoters of welfare economics defend their framework on the ground that it promises to reduce discretion, judgment, and other trappings of robust collective agency. They hope to eliminate such agency because they believe that the view of regulation from nowhereâ the objective view that attaches no special signiïŹ cance to the identity of the po liti cal community that is engaged in policy makingâ best avoids oppressive, paternalistic, corrupt, or otherwise misguided government action. What ever its success at achieving those aims, the economic framework has taken us too far in the direction of nowhere, causing us to lose sight of ourselves and our challenges by promising that the normativity of environmental law can be determined through empirical assessment of welfare consequences alone. â Douglas A. Kysar, Regulating from Nowhere, 652
