State constitutions contain education guarantees with no federal counterpart
Evidence
Robinson transformed the campaign for school finance reform by reminding potential litigants that state systems of school finance had to satisfy state, as well as federal, constitutional requirements. It showed that the applicable state provisions were not identical to those in the federal Constitution; there was no federal analogue to the “thorough and efficient” clause or to other state constitutional requirements (see Box 11.1). Robinson also reminded litigants that a favorable ruling on school finance under the state constitution could not be reversed by the Box 11. — G. Alan Tarr, Judicial Process and Judicial…, 3284
Categorization
- XREF: Directly serves the course goal of linking foundational values like equality to doctrine: state constitutional text grounds school-finance equality claims federal doctrine cannot.
- DEFINE: Clarifies what ‘thorough and efficient’ means operationally: a state-only textual hook for litigating school funding.
