Fairness is listed as a key principle or value
Evidence
The general principle latent in these diverse applications of the idea of justice is that individuals are entitled in respect of each other to a certain relative position of equality or inequality. This is something to be respected in the vicissitudes of social life when burdens or benefits fall to be distributed; it is also something to be restored when it is disturbed. Hence justice is traditionally thought of as maintaining or restoring a balance or proportion, and its leading precept is often formulated as ‘Treat like cases alike’; though we need to add to the latter ‘and treat different cases differently’. — HLA Hart, The Concept of Law (Clarendon Law…, 418 (

“The ‘reasonableness’ doctrine in domestic law permits certain adults to use physical force against children with impunity. The Committee recognizes that, historically, this doctrine provided some protection to children by limiting the severity of permitted punishment. But it is fundamentally incompatible with the Convention because it creates a class of human beings — children — who may lawfully be subjected to physical violence that would constitute assault if directed at adults. The equal protection of the law, which Article 2 of the Convention requires states to ensure without discrimination, demands that children receive at least the same protection from physical violence that adults receive. The ‘reasonableness’ limitation on parental physical force toward children cannot survive this requirement.” — , The Rod and the Child, 7597 (
