Congress mandated federal agencies and district courts adopt ADR programs in the 1990s
Evidence
In 1990, Congress enacted the Administrative Dispute Resolution Act, which requires federal agencies to consider ADR for settling disputes; and in 1998, it enacted the Alternative Dispute Resolution Act, requiring district courts to establish ADR programs. More than half the states have established their own ADR programs. Corporations and other private institutions have also pioneered their own mechanisms for resolving disputes without recourse to the courts. — G. Alan Tarr, Judicial Process and Judicial…, 1163
