Civil libertarians scored only modest court checks on executive power
Evidence
As in the 1960s, civil libertarians have challenged the government’s increasing power to detain and punish its own citizens without just cause or evidence. Modest victories have been scored in the cases of Hamdi v. Rumsfeld (2004), Hamdan v. Rumsfeld (2006), and Boumediene v. Bush (2008), in which the US Supreme Court acted to check the unlimited power of the executive branch. — Carl W. Ernst, Islamophobia in America_ The Anatomy of…, 419
